1. Nannies in Training is not responsible for the payment of salaries and wages of any of our placements. This is an agreement between the Employer and employee.

2. The employer is responsible for setting up and signing an employment contract with the successful candidate. Nannies in Training is able to provide a generic employment contract.

3. Nannies in Training offers a 30 day guarantee on placements.

3.1.     Should the Client cancel the contract prior to the start date for whatever reason once the placement has been confirmed and the placement has accepted the position, the Client will be refunded the placement fee minus R700 administration fee to cover work already carried out by Nannies in Training.

3.2.     Should the placement cancel the contract prior to start date for whatever reason Nannies in Training will endeavour to arrange a replacement and propose an alternative suitable candidate within 2 weeks. If Nannies in Training cannot propose an alternative suitable candidate within that period, the Client will be refunded the placement fee in full. Nannies in Training will continue to find someone suitable for the client, if the client wishes us to.

3.3.     If, during the selected guarantee period, the the client needs to hire a new nanny because the placement decided to leave or because the contract was terminated, Nannies in Training will undertake to replace the candidate free of charge, provided that the placement fee was paid prior to candidate commencing work.

3.4.     Should the contract be terminated during the selected guarantee period and Nannies in Training is not given the opportunity to replace a candidate and/or make alternative arrangements via another source, no refund will be given if the Client no longer wishes to hire a domestic or child minder, regardless of the reason. If, within the selected guarantee period, the client decides that they no longer require a Nanny or Domestic Worker, no refund is given.

4. Nannies in Training undertakes to replace the employee with a candidate willing and able to fulfil the same tasks and duties as originally agreed upon. Whereas every effort is made to replace the employee as soon as possible, Nannies in Training undertakes to replace the employee within two weeks of the employee leaving or of being advised that a replacement is required.

5. Please Note that Nannies in Training terms and conditions specifically excludes:

5.1.     Retrenchment

5.2.     Unfair dismissal

5.3.     Illness and death

5.4.     Breach of employment contract by the employer.

6. Refunds can only be made to Clients having paid before the start date & where Nannies in Training has received written notification within 48 hours stating that the employment has been terminated. R700 of the placement fee is retained by Nannies in Training for administration and work completed.

7. A once off placement fee is charged based on the selected guarantee period .  The placement fee is payable 48 hours before the successful candidate commences work. 

8. For Temporary or Short Term Placements, a once off placement fee is applicable. Should the temporary placement continue for more than 3 months, the balance of the placement fee is payable.

9. A interview  session fee of R40 per candidate is applicable. This is to cover the ladies transport and any administration from Nannies in Training.

10. Failure to pay on time will result in a surcharge. The employee will not commence work until the placement fee is paid in full. If the fee remains unpaid on the start date, a 15% surcharge on any unpaid placement fee will be payable on the unpaid fee. The Client will also forfeit their right to a replacement or refund if the payment is late.

11. Should a placement terminate after the selected guarantee period, Nannies in Training is not obliged to pay a refund or offer a free replacement. No refunds will be made on replacement Nanny or Domestic Workers.

12. Interviewing a candidate from Nannies in Training will indicate acceptance of both the fee structure and terms & conditions.

13. All Nannies in Training candidates are covered by a 12-month exclusivity agreement. This provides that in the event of a candidate being employed within 12 months of the initial Nannies in Training organised interview, the full placement fee will become immediately payable to Nannies in Training. The use of a third party to "recruit" a candidate, in order to avoid the payment of fees to Nannies in Training, will incur a similar charge, either to the third party, or to the client, should the third party demur acceptance of these conditions.

14. Nannies in Training acts as an intermediary only and is not the employer. The Client must ensure they are 100% sure of the suitability of the potential placement prior to hiring them – Nannies in Training is not responsible if the placement proves to be unsuitable. The choice of placement remains the Client’s decision. By submitting the application form, the Client accepts these terms and conditions.

15. Whereas every effort is made to ensure that the person working in your home is honest and competent and does not have a history of negligence or clumsiness, accidents do occur. Nannies in Training accepts no liability of any kind for any inconvenience, loss of or damage to property, or any loss or personal injury or death howsoever arising directly or indirectly from any act or omission of any applicant introduced by Nannies in Training even if such an act or omission is negligent or fraudulent or reveals dishonesty.

16. Although Nannies in Training endeavours to ensure that the qualifications and references of job applicants are reasonably verified, we cannot be held responsible for undetected deliberate fraud or misrepresentations made to Nannies in Training or the client by any placed or interviewed person.

17. In the event of any dispute arising out of or relating to this agreement, such dispute shall be resolved in Johannesburg, South Africa.

17.1. The Client shall be liable to the trust for all legal expenses on the Attorney Client scale of an Attorney and Counsel incurred by Nannies in Training in the event of (a) any default by the Client or (b) any litigation in regard to the validity and enforceability of this agreement.

17.2. The Client will also be liable for any collection or valuation fees incurred.

17.3. The Client agrees that Nannies in Training shall not be liable to make payment of security into Court in terms of section 62 of the Magistrate’s Court Act, as amended. The Client hereby consents to the jurisdiction of the Magistrates Court. The Client chooses Domcilium citandi et executandi for services of all documents and processes the address entered in. In the case of a Client owing funds to Nannies in Training, for whatever reason, the Client consents to default judgement being taken against him / her in terms of the section 58 of the Magistrates court act in the case of non performance.
